Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Smoke Brothers Guild (the “Service”), including all content, features, tools, training, community areas, and AI assistance offered on the site. By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms, our Privacy Policy, our Disclaimer, and our Refund Policy. If you do not agree, do not use the Service.

You must be at least 18 years old to create an account or purchase a subscription. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@smokebrothersguild.com if you suspect unauthorized use.

Smoke Brothers Guild offers a free tier and paid membership plans, including monthly subscriptions and a one-time Pitmaster Path training purchase. Current pricing is shown on the Membership page.

Auto-renewal. Monthly subscriptions renew automatically at the then-current price on each billing date until you cancel. You authorize us and our payment processor to charge your payment method on each renewal.

How to cancel. You may cancel a monthly subscription at any time from your account settings or by emailing support@smokebrothersguild.com. Cancellation stops future renewals; you retain access through the end of the current paid billing period.

Price changes. We may change subscription pricing for future billing periods. We will give you reasonable advance notice, and you may cancel before the change takes effect.

Taxes. Applicable sales tax, VAT, GST, or similar taxes may be added to your purchase based on your location and applicable law.

Purchases described as “one-time,” “lifetime,” or “for life” — including the $97 Pitmaster Path training purchase — refer to the operating lifetime of the Smoke Brothers Guild service, not the lifetime of the purchaser. As long as Smoke Brothers Guild operates, purchasers of the Pitmaster Path training program retain access to the training content they purchased, regardless of whether they maintain a monthly subscription. If the Smoke Brothers Guild service is ever permanently discontinued, Smoke Brothers Guild may, at its discretion, provide purchasers with downloadable copies of purchased training materials or another reasonable remedy, but continued online access is not guaranteed beyond the life of the service. Monthly subscription fees are not refundable upon service discontinuation except as required by law.

Monthly subscriptions (Guild Membership, Full Access, and the recurring portion of the Pitmaster Path) are non-refundable. You may cancel at any time to prevent future charges, and you retain access through the end of your current paid period. We do not offer prorated refunds for partial months.

Pitmaster Path one-time payment ($97). We offer a 30-day money-back guarantee on the $97 one-time Pitmaster Path training purchase. If you are not satisfied, email support@smokebrothersguild.com within 30 days of purchase to request a refund. Refunds are issued to your original payment method. Upon refund, your permanent training access is revoked. The recurring $7.99/month portion is governed by the monthly subscription refund rule above.

Subject to your compliance with these Terms and payment of applicable fees, Smoke Brothers Guild grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. All content, code, designs, recipes authored by Smoke Brothers Guild, training materials, and AI prompts remain the property of Smoke Brothers Guild or its licensors.

You may submit recipes, comments, questions, profile information, and other content to the Service (“User Content”). You retain ownership of your User Content. By submitting User Content, you grant Smoke Brothers Guild a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, adapt, publish, translate, publicly display, and distribute your User Content in connection with operating and promoting the Service.

You represent and warrant that you own or have all necessary rights to your User Content and that it does not infringe any third-party rights or violate any law. Smoke Brothers Guild may remove, edit, or refuse to publish User Content at any time in its sole discretion.

You agree not to:

• use the Service to violate any law or third-party right;
• post content that is unlawful, harassing, defamatory, obscene, hateful, or that promotes unsafe food-handling practices;
• attempt to jailbreak, exploit, reverse-engineer, or misuse the Pitmaster AI, recipe Q&A, or any other AI feature, including using it to generate illegal, harmful, or infringing content;
• scrape, crawl, or bulk-download the Service, or use automated means to access it without our written permission;
• share your account, resell access, or use the Service to build a competing product; or
• interfere with, disrupt, or attempt to gain unauthorized access to the Service, other users' accounts, or the underlying systems.

The Service includes AI-powered features such as Pitmaster AI, recipe Q&A, AI-generated cook timelines, and AI-generated images. AI outputs are generated by machine-learning models and may be inaccurate, incomplete, or unsuitable for your situation. Do not rely on AI outputs as your sole source of food-safety, medical, or other critical guidance. Independently verify all AI-generated temperatures, times, cure ratios, and food-safety instructions against authoritative sources as described in our Disclaimer. Smoke Brothers Guild makes no warranty regarding the accuracy or fitness of AI outputs for any purpose.

Smoke Brothers Guild respects intellectual property rights. If you believe content on the Service infringes your copyright, send a written notice to support@smokebrothersguild.com that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material and its location on the Service; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized; and (f) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act. We will respond to valid notices consistent with the Digital Millennium Copyright Act.

The Service uses third-party providers for payments, hosting, authentication, email, analytics, and AI. It may also include affiliate links to third-party products. We are not responsible for third-party services or products, and their terms and privacy policies govern your use of them.

You may stop using the Service and close your account at any time. Smoke Brothers Guild may suspend or terminate your access, with or without notice, if you violate these Terms, if we reasonably suspect fraudulent or abusive activity, or if we discontinue the Service. On termination, sections that by their nature should survive (including sections 4, 6, 7, 9, 13, 14, 15, 16, and 17) will survive.

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. Food-safety content is educational only. See our Disclaimer for the full food-safety notice, which is incorporated into these Terms by reference.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMOKE BROTHERS GUILD, ITS OWNERS, OPERATORS, CONTRIBUTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR PERSONAL INJURY, ILLNESS, PROPERTY DAMAGE, OR LOST PROFITS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID SMOKE BROTHERS GUILD IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $100.

You agree to indemnify, defend, and hold harmless Smoke Brothers Guild and its owners, operators, contributors, employees, and affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

These Terms are governed by the laws of the United States and, to the extent applicable, the laws of the state in which Smoke Brothers Guild's operator is domiciled, without regard to conflict-of-laws rules. Any dispute shall be resolved by binding individual arbitration on a non-class basis, except that either party may bring an individual claim in small-claims court. You and Smoke Brothers Guild each waive the right to a jury trial and to participate in a class action.

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or by posting a notice on the Service). Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
